November 28, (THEWILL) – The Court of Appeal, Ibadan Division, has set aside a judgment of the Federal High Court, Abeokuta, Ogun State, which ordered the Peoples Democratic Party (PDP) to conduct fresh primaries for the 2023 election in the State.

Justice O O Oguntoyin had in a September 27 judgment, nullified the primary election conducted by the PDP in Ogun state and directed the State Executive Committee of the Party to conduct fresh primaries within 14 days.

The ruling followed a suit filed by Jimi Lawal, challenging the election of Dr Oladipupo Adebutu as the governorship candidate of the party for the 2023 election.

But, while delivering judgment in an appeal filed by the PDP, Justice Folasade Ojo said the lower court was wrong in its judgment as only the National Working Committee (NWC) of the PDP is vested with the power to conduct primaries.
