The court of Appeal in Abuja, has set aside the judgement of the National and State House of Assembly Election tribunal in Asaba, which nullified the election of Ngozi Okolie, the Labour Party member representing Aniocha/Oshimili federal constituency, in the House of Representatives.
THEWILL recalls that the tribunal had declared Ndudi Elumelu, candidate of the Peoples Democratic Party (PDP), as winner of the 2023 election for Aniocha/Oshimili federal constituency, Delta state.
But the appellate court, in a judgement on Thursday, voided the tribunal judgement.
Affirming the election of Okolie, the Court agreed with Mahmud Magaji (SAN), the lawyer to the LP, that contrary to the tribunal’s verdict, Okolie was duly nominated and sponsored by his party.
It held that the LP chieftain resigned his appointment as a Senior Special Assistant (SSA) to Delta state government in line with the new Electoral Act 2022.
