June 02, (THEWILL) – The Presidential Election Petition Court (PEPC), Abuja, has adjourned until Friday, June 9, hearing in the petition filed by the Allied Peoples Movement (APM) against the election of President Bola Ahmed Tinubu.
A five-member panel of the Court, led by Justice Haruna Tsammani, ordered the adjournment to give respective parties time to acquire a certified true copy of the Supreme Court judgement delivered on May 26, which laid to rest the controversy around the double nomination of Senator Kashim Shettima as the APC Vice Presidential candidate.
THEWILL recalls that the apex court, led by Justice Okoroh, had on Friday, May 26, dismissed the appeal filed by the Peoples Democratic Party (PDP) on the double nomination of Vice President Kashim Shettima.
The APM is challenging the election of President Bola Tinubu, over the nomination of his Vice President, Shettima.
The party, in its petition, contends that the withdrawal of Ibrahim Masari, who was initially nominated as the Vice Presidential candidate of the APC, invalidated Tinubu’s candidacy in view of Section 131(c) and 142 of the 1999 Constitution, as amended.
THEWILL recalls that at the last hearing of the petition on Tuesday, Wole Olanipekun, lead counsel to Tinubu, had argued that the petition doesn’t stand, as the Supreme Court had laid to rest the issue of the nomination of Vice President Kashim Shettima.
The tribunal had adjourned until June 2, to enable parties to obtain copies of the apex court judgement.
However, at the resumed hearing of proceedings on Friday, the matter was further adjourned until June 9, because counsels have not been able to obtain copies of the Supreme Court judgement.
