
April 18, (THEWILL) – The Federal High Court in Abuja has declined hearing on an ex-parte application, filed by the candidate of the All Progressives Congress (APC), Senator Aisha Dahiru Ahmed, seeking to halt further action on the ongoing governorship election in Adamawa State.
In the ex parte application filed by her counsel, Mohammed Sheriff, Binani is asking the court to determine whether the independent electoral commission (INEC), can take any further steps on the declared governorship election results announced by its resident electoral commissioner, Hudu Ari.
Ruling on the ex-parte application on Tuesday, Justice Inyang Ekwo asked Binani’s counsel to first address the issue of jurisdiction, before entertaining the ex-parte application.
Justice Ekwo asked Binani’s counsel to file his address and adjourned to April 26 for a hearing.
The suit is challenging INEC’s action voiding Binani’s declaration as winner of the governorship elections of Adamawa state, which was held on march 18 and the supplementary election held on April 15, 2023.
Binani is also seeking an order of prohibition and certiorari, preventing INEC and its agents from taking any further steps towards the declaration of the winner of the election pending the determination of her application for Judicial review.
