August 08, (THEWILL) – The Court of Appeal, Abuja, has fixed August 19, 2022, as date for proper hearing in the appeal seeking to upturn the judgement of the Federal High Court declaring Olorogun David Edevbie, as the lawful and authentic candidate of the Delta State Peoples Democratic Party (PDP) for the 2023 governorship election.
THEWILL reports that the Federal High court, presided over by Justice Taiwo Taiwo, had on Thursday, July 7, 2022, disqualified Sheriff Oborevwori, as governorship candidate of PDP for the 2023 guber election in Delta State.
Justice Taiwo had faulted the certificates and other documents filed by Sheriff Oborevwori for nomination as the gubernatorial candidate of the PDP and ordered the party and Independent National Electoral Commission (INEC) to recognise Edevbie as the rightful and lawful candidate of the party for the 2023 Delta governorship election.
But Oborevwori in an Appeal challenging the High Court ruling, insisted that it conducted a valid governorship primary that produced Oborevwori as its guber candidate.
The Court of Appeal had last week, ordered substituted service on Edevbie. The Appellate Court issued the order following a motion for substituted service filed by the Oborevwori, on Edevbie, who had allegedly evaded court service.
The Court also adjourned to August 8, to enable Counsel to the Appellant, Ekeme Ohwovoriole (SAN), to file and move the motion to abridge time and accelerated the hearing of the Appeal.
However, at the proceeding on Monday, the judges granted a request for the abridgement of time to enable an expeditious trial.
Accordingly, all the respondents have been asked to file their replies within eight days, while the appellant is to respond within two days.
