January 19, (THEWILL) – The All Progressives Congress (APC), Chairmanship candidate in the last State Congresses of the party in Benue state, Barr. Omale Omale has dragged the party to Court over election results.
In a suit no: MHC/14/22, filed at High Court, Makurdi Judicial Division, Omale is praying the Court to restrain the APC from swearing in Mr Austin Agada as the Chairman-elect of the party in Benue state.
Omale and the two others, who filed the suit are also seeking the court to restrain the APC from swearing in the Treasurer-elect and the Assistant Secretary-elect pending the determination of the substantive suit.
The suit which was filed by J.S. Okutepa and J.J. Usman, Counsels to the plaintiffs, insisted that his clients were consensus candidates of the party during the primaries.
In the originating summons filed by Counsels to Omale Omale, urged the Court to restrain Agada and the two others from parading themselves as Chairman-elect, Treasurer-elect and Assistant Secretary-elect.
The Motion of Notice was brought before the Court, pursuant to Order 39, Rule 1 of the Benue State High Court (Civil Procedure) Rules, 2021.
The notice is seeking among other reliefs, An order of interlocutory injunction restraining the 1st Defendant/Respondent (APC) by itself, servants, agents, privies or otherwise however from swearing-in the 2nd – 4th Defendants/Respondents as the Chairman, Treasurer and Assistant Secretary of the 1st Defendant/Respondent (APC) in Benue State, pending the determination of the substantive suit.
“An order of the High Court restraining the 2nd, 3rd and 4th Defendants/Respondents from parading themselves as the Chairman-elect, Treasurer-elect and the Assistant Secretary-elect of the 1st Defendant/Respondent (APC) in Benue state pending the determination of the substantive suit.”
It would be recalled that the APC in the state has been fictionalised since the State Congresses of the party that was held in 2021.
No date is yet to be fixed for the hearing of the case.
