March 20, (THEWILL) – The House of Representatives has approved the state of emergency declared in Rivers State by President Bola Tinubu, adopting a voice vote in a move that has further heightened tensions surrounding the controversial decision.
The approval came during Thursday’s plenary session, presided over by Speaker Tajudeen Abbas, following the consideration of a letter from the President seeking the legislature’s backing for the emergency rule.
President Tinubu, in a nationwide address on Tuesday evening, announced the suspension of the executive and legislature in Rivers State and appointed retired naval officer Vice Admiral Ibok-Ette Ibas as administrator.
According to Section 305(6) of the 1999 Constitution (as amended), a presidential proclamation of a state of emergency ceases to be effective unless approved by two-thirds of both chambers of the National Assembly within 48 hours when in session, or within ten days when not in session.
For the proclamation to stand, the Senate requires the approval of at least 73 out of 109 senators, while the House of Representatives needs a minimum of 240 out of 360 members.
Although 243 members reportedly attended Thursday’s plenary session, controversy surrounds the adoption of a voice vote instead of a formal headcount to confirm the required majority. Critics argue that the method leaves room for ambiguity regarding the exact number of lawmakers in support or opposition.
In addition to approving the emergency rule, the House recommended the establishment of a national committee to restore peace in Rivers State and proposed that the National Assembly take over the functions of the Rivers State House of Assembly for the duration of the emergency rule.
Lawmakers also resolved that the emergency period could be reviewed at any time, without necessarily waiting for the six-month duration stipulated in the proclamation.
Speaker Abbas subsequently adjourned plenary to March 24. implementation of emergency rule in the oil-rich state.
