May 06, (THEWILL) — The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has reaffirmed its commitment to due process, filing a counter-affidavit opposing a fresh bail application by former Kaduna State Governor, Nasir El-Rufai, in an ongoing case before the Kaduna State High Court.
At Tuesday’s resumed proceedings, counsel to the defendant, Ubong Akpang, informed the court of a pending bail application, stressing that it directly concerns the defendant’s liberty. He stated that all necessary processes had been duly filed and served, expressing readiness to proceed with the hearing.
However, counsel to the ICPC, Ibrahim Mukhtar, told the court that he had only just been served with the defendant’s further affidavit in support of the bail application. He requested additional time to study the new filings to enable a comprehensive response.
However, the presiding judge, Justice D.H. Khobo, adjourned the matter to May 13, 2026, for the hearing of the fresh bail application.
The adjournment follows an earlier decision by the court declining bail to El-Rufai. In that ruling, Justice Khobo held that the defendant failed to file a further affidavit to counter the ICPC’s claims, which introduced new and significant allegations.
Among the issues raised were concerns over a possible flight risk given the defendant’s influence and resources, alleged obstruction during an attempted lawful arrest at the Nnamdi Azikiwe International Airport, refusal to surrender travel documents and electronic devices, and the potential to interfere with witnesses and evidence.
The court emphasised that bail is discretionary and must align with the interests of justice. It further noted that the defendant’s high profile could impact ongoing investigations, particularly as some suspects are still at large.
Justice Khobo also dismissed claims regarding the defendant’s health due to lack of supporting medical evidence. Consequently, the court ordered that El-Rufai remain in ICPC custody pending the commencement of trial and directed an accelerated hearing of the case.
Despite the earlier ruling, the defence proceeded with a fresh bail application, prompting the ICPC’s latest opposition.
Reiterating its mandate, the Commission assured the public of its continued dedication to the diligent prosecution of corruption cases and the strict observance of due process.
The case has been adjourned to May 13, when both parties are expected to present arguments on the renewed bail application.
