February 25, (THEWILL) – A Magistrate Court sitting in Yaba, Lagos, has discharged and acquitted Singer, Abdulazeez Fashola, popularly known as Naira Marley, Balogun Olamilekan Eletu, also known as Sam Larry, Owodunni Ibrahim, popularly known as Prime Boy, and Opere Babatunde, of complicity in the death of Aloba Oladimeji Ileri-Oluwa (a.k.a. Mohbad).
This follows the legal advice of the Department of Public Prosecution (DPP).
The suspects had been accused of complicity in the death of Mohbad on September 12, 2023. Ms Feyisayo Ogedengbe, an Auxiliary Nurse contacted and invited by Ayobami Sadiq (a.k.a Spending), a friend of Mohbad on 11th September 2023, to treat the singer at the deceased’s residence in Lekki, had been in police custody.
Ruling on the matter on Tuesday, Magistrate E. Kubenje, agreed that while an unlawful assault was carried out by Naira Marley, Sam Larry, Babatunde, and Primeboy, it could not rise to the point of criminal responsibility for Mohbad’s death.
Kubenje added that Mohbad had previously on October 11, 2022, withdrawn his complaint against Naira Marley, dated October 11, 2022, on assault, on the grounds that the matter had been settled amicably.
The court, however, established a prima facie case of the offence of reckless and negligent acts, against Feyisayo Ogedengbe (nurse) and Ayobami Sadiq respectively.
The court, therefore, ruled that Ogedengbe and Sadiq shall be prosecuted for the offence of recklessness and negligence, which is contrary to Section 251(e) of the Criminal Law, Ch C.17, Vol.3, Laws of Lagos State, 2015, at the Magistrate’s Court.
Meanwhile, the case has been adjourned to March 24, 2025, for mention.
