December 16, (THEWILL) – The quest by the former senator representing Cross River Central in the national assembly, John Owan Enoh, to take possession of the State’s APC Guber Ticket, has suffered another setback.
This follows the dismissal of the appeal he filed at the Federal Court of Appeal, Calabar, against the ruling of the Federal High Court, Calabar.
In Suit No: CA/C/337/2022, between senator John Owan Enoh vs senator Bassey Edet Otu, the court dismissed the case for lack of merit.
Chairman of the Appeal Court panel, Hon. Justice J. O Bada, dismissed the case in favour of Senator Edet Bassey Otu, for lack of merit.
The appeal panel said Senator Bassey Edet Otu was fully cleared and that the mandate given to him by the APC National Working Committee and affirmed by the lower court was genuine.
Earlier, the Federal High Court presided over by Justice Ijeoma Ojukwu dismissed Senator Enoh’s case and upheld Senator Bassey Otu’s election as the APC’s authentic candidate.
Justice Ijeoma Ojukwu in her over 90 minutes judgement, said the plaintiff, Senator John Owan Enoh, failed to prove his claims in the case.
The judge further held that in the seven-paragraph affidavit, submitted by Senator Owan Enoh, the allegation of forgery could not be established.
She further held that the nomination of a candidate is the duty of the political party and the court has no right to meddle in it.
She added that the national working committee of a political party has the final say on who the party’s candidate is.
