March 17, (THEWILL) — The Nigerian Bar Association (NBA) has condemned what it described as a humiliating and unrecognised courtroom sanction, following reports that a judge of the Federal High Court, Abuja, ordered a lawyer representing activist, Omoyele Sowore, to kneel while proceedings were ongoing.
In a statement issued on Tuesday, NBA President, Afam Osigwe (SAN), said the Association received reports that Justice Mohammed Umar directed Marshall Abubakar, lead defence counsel to Sowore, to step out of the Bar and kneel down after raising his voice while addressing the court over a hearing date.
The judge was also alleged to have threatened the lawyer with committal for contempt.
Reacting, the NBA said while judges have the authority to maintain order and discipline in their courtrooms, such powers must be exercised strictly within the bounds of the law and established judicial procedures.
“The courtroom is a temple of justice, governed by law, procedure, and decorum”, the statement noted, stressing that the power to punish for contempt must follow clearly defined legal processes that guarantee fairness and respect for human dignity.
The Association maintained that directing a legal practitioner—or any individual—to kneel in court is not a recognised judicial sanction under Nigerian law and does not align with expected standards of conduct on the Bench.
It emphasised that the dignity of the court must be preserved not only in its judgements but also in the manner judicial authority is exercised.
According to the NBA, where a judge considers any conduct contemptuous, due process must be followed in addressing such behaviour, rather than resorting to measures considered degrading or extrajudicial.
The Association, however, reminded lawyers of their professional responsibility to maintain decorum, civility, and respect for the court at all times. It noted that while legal practitioners are duty-bound to represent their clients fearlessly, such advocacy must remain within the limits of courtesy and proper courtroom conduct.
Highlighting the importance of harmony within the justice system, the NBA said the relationship between the Bar and the Bench must be anchored on mutual respect, describing it as essential to the effective administration of justice.
The body called for calm among all parties and urged that any grievances arising from courtroom incidents be addressed through appropriate institutional and disciplinary channels.
It also signalled its readiness to engage relevant authorities where necessary to ensure that the rule of law, judicial ethics, and professional standards are upheld.
