October 03, (THEWILL) — The Nigerian Bar Association (NBA) has cautioned the Nigeria Police Force against enforcing the newly introduced tinted glass permit policy, warning that such action would amount to contempt of court.
In a letter dated October 1, 2025, and addressed to the Inspector-General of Police, the NBA Section on Public Interest and Development Law (NBA-SPIDEL) drew attention to the pendency of Suit No: FHC/ABJ/CS/1821/2025 before the Federal High Court, Abuja.
The suit, filed by the Incorporated Trustees of the NBA, challenges the legality, constitutionality, and lawfulness of the policy. NBA-SPIDEL noted that advance copies of the originating summons and a motion for interlocutory injunction were served on the Police Directorate of Legal Services on September 25, 2025.
It stressed that once a motion for injunction has been filed, the Police are legally bound to maintain the status quo until the court makes a pronouncement.
The association expressed concern over statements credited to the Force Public Relations Officer, CSP Benjamin Hundeyin, and some state police commands suggesting that enforcement of the policy would commence on October 2, 2025, despite the pending case.
NBA-SPIDEL described such comments as “an egregious act of disregard and contempt for the majesty of the court,” warning that contempt and committal proceedings could be initiated against CSP Hundeyin if he continues to downplay judicial authority.
It also advised the Officer in Charge of the Police Directorate of Legal Services, AIG Ohiozoba D. Ehiede, to provide proper legal guidance to ensure that the Police respect judicial processes.
It further cautioned that attempts to undermine the rule of law could expose him to disciplinary action before the Legal Practitioners Disciplinary Committee (LPDC).
The association therefore urged the Inspector-General of Police to suspend enforcement of the tinted glass permit policy until the court delivers its judgment, stressing that “the rule of law must prevail over the rule of force.”
