October 25, (THEWILL) – The Benue State Government has withdrawn from the suit challenging the constitutionality of the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices and Other Related Offences Commission (ICPC), currently before the Supreme Court.
This is just as the suspension of the Attorney General and Commissioner for Justice and Public Order, Barr Fidelis Mnyim, continued.
In an application signed by Fidelis Mnyim for the Benue State Attorney General and Commissioner for Justice and Public Order, dated October 23, 2024, the Benue State Government announced its decision to withdraw from Suit No: SC/CV/178/2023 before the apex court challenging the legality of the EFCC.
“Take notice that the Attorney General of Benue State, who is the 8th plaintiff, hereby, discontinues this suit against the Attorney General of the Federation, the defendant”, it reads.
THEWILL recalled that Governor Hyacinth Alia had approved the suspension of the Attorney General and Commissioner for Justice and Public Order, Barr Bemsen Mnyim, over a breach of protocol in governance.
The Governor, who gave the directive at Government House on Wednesday, during a press conference shortly after the Benue State Executive Council meeting, said the indefinite suspension is with immediate effect.
“This suspension was necessitated by Commissioner’s ultra vires decision to join Benue State in a suit challenging the legality of anti-graft agencies, namely the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices Commission (ICPC).”
In a statement, the Chief Press Secretary, Sir Tersoo Kula, quotes the governor as saying, that no appointee is permitted to act unilaterally, no matter how pressing or urgent the issue is.
