December 18, (THEWILL) — Motorists nationwide have scored a major relief after a Delta State High Court restrained the Nigeria Police Force from implementing the tinted glass permit policy scheduled to take effect on January 2, 2026.
The order was issued on Wednesday, December 17, by Justice Joe Egwu of the High Court of Justice, Otorerokpe Judicial Division, Otorerokpe, in a fundamental rights enforcement suit filed by Mr. Israel Joe (Suit No. HOR/FHR/M/31/2025).
The Inspector General of Police, the Nigeria Police Force, and the Delta State Commissioner of Police were named as respondents.
Granting the ex parte application, the court barred the respondents, their officers, agents, or contractors from enforcing or implementing the tinted glass permit policy pending the hearing of the substantive suit. Justice Egwu further prohibited the respondents from stopping, harassing, arresting, detaining, or extorting motorists under the guise of enforcing the policy, noting that such acts could violate constitutionally guaranteed rights to human dignity, privacy, freedom of movement, and property.
The court also restrained the respondents from using the Parkway Projects account, a private contractor’s account, for government business pending the outcome of the suit.
Substituted service was authorised, allowing the IGP and Nigeria Police Force to be served via the Delta State Commissioner of Police at the Police Headquarters in Asaba.
After submissions by the applicant’s counsel, led by Kunle Edun, SAN, the court granted the motion as prayed and adjourned the matter to December 24, 2025, for the hearing of the motion on notice.
