July 15, (THEWILL) – A Kano State High Court has restrained Alhaji Aminu Ado Bayero and four other dethroned Emirs of Bichi, Rano, Gaya, and Karaye from parading themselves as Emirs.
Delivering the judgment on Monday, Justice Amina Adamu-Aliyu further issued an order of perpetual injunction restrained the 15th Emir of Kano and four other Emirs whosoever by themselves, servants, privies and any other persons appointed by them from parading themselves as Emirs of Kano, Bichi, Gaya, Rano and Karaye.
The Kano State Government had filed a case asking the State High Court to stop the 15th Emir and four other Emirs of Karaye, Bichi, Rano and Gaya from parading themselves as Emirs.
The applicants, the Attorney-General of Kano State, the Speaker of the Kano State House of Assembly and the Kano State House of Assembly, had through their counsel, Ibrahim Isah-Wangida Esq, filed a motion ex-parte dated May 27, seeking a court order on the respondents.
The respondents are Ado-Bayero, Alhaji Nasiru Ado-Bayero, emir of Bichi, Dr. Ibrahim Abubakar ll, emir of Karaye; Alhaji Kabiru Muhammad-Inuwa, emir of Rano, and Alhaji Aliyu Ibrahim-Gaya, emir of Gaya. Others are the Inspector General of Police, Director of State Security Service, Nigeria Security and Civil Defence Corps and Nigerian Army.
Justice Adamu-Aliyu held that the Kano State House of Assembly had powers to amend and propose a bill for the peace and good governance of the state under section 4 rule 6,7(b) of the 1999 Constitution as amended.
“The Kano State Governor has the right to assent the proposed bill to law after being passed by the State Assembly.
“The deposed Emirs shall surrender all movable and immovable properties in their possession that belong to the Kano State Emirate Council to the State Government,” the court held.
It further restrained the Police and other security agencies from violating, disobeying or tempering the Kano State Emirate (Repeal) Law 2024.
The Judge said the act of the 6th to 9th respondent for smuggling Emir Bayero to Kano after the enactment of the Emirate Repeal Law 2024, was a complete disregard for the protection of life and property.
