SAN FRANCISCO, September 20, (THEWILL) –Â The Supreme Court on Wednesday reaffirmed its stance on the sack of Herman Hembe, from the House of Representatives as member representing Vandeikiya/Konshisha federal constituency of Benue State.
The apex court had on June 23, sacked Hembe and ordered the Independent National Electoral Commission, INEC, to present Dorathy Mato with the certificate of return of Vandeikiya/Konshisha federal constituency.
It also ordered Hembe to return all the salaries and allowances he collected while in office.
But in an application, the sacked lawmaker urged the Supreme Court to refer the matter to a lower court for retrial, praying the court to wave the orders because he did not have money to pay.
Delivering its verdict on Wednesday, the five-man panel of judges led by the Chief Justice of Nigeria, CJN, Justice Walter Onnoghen, ruled that the judgment could not be revisited.
The application was struck out by the Supreme Court which awarded the sum of one million naira against Hembe in favour of Mato, the defendant.
