June 28, (THEWILL) – The Court of Arbitration for Sport (CAS) has dismissed the appeals by World Athletics (WA) and the World Anti-Doping Agency (WADA) against Nigerian hurdler Tobi Amusan. This decision upholds the earlier finding by the World Athletics Disciplinary Tribunal (WADT) that Amusan did not commit any anti-doping rule violations.
CAS convened on January 19 to deliberate on the appeals, which sought to impose two years of ineligibility on Amusan. The appeals were based on the allegation that Amusan had committed three whereabouts failures within 12 months. However, the CAS panel found no evidence of a missed test, which would have constituted the third whereabouts failure.
Initially, Amusan was charged with an anti-doping rule violation (ADRV) under Rule 2.4 of the WA Anti-Doping Rules due to the alleged whereabouts failures. The CAS panel acknowledged two filing failures but did not confirm the existence of a missed test, leading to the conclusion that Amusan did not commit an ADRV.
The CAS panel’s decision confirms that Amusan did not violate Rule 2.4 of the WA Anti-Doping Rules. Consequently, no period of ineligibility will be imposed on her. This outcome allows Amusan to continue her athletics career without any sanctions.
