October 03, (THEWILL) — A U.S. federal judge has ordered the owners of Westgate Discount Mall in Georgia to pay Louis Vuitton $584m in damages, after the luxury brand accused the shopping complex of enabling large-scale sales of counterfeit goods.

The ruling, one of the largest ever in an American counterfeiting case, followed a lawsuit filed by Louis Vuitton in April 2023.

The fashion house alleged that the mall knowingly permitted the sale of fake versions of its products at its outdoor flea market, ignoring repeated warnings.

The case stemmed from a 2021 Homeland Security raid in which counterfeit goods were found in 60 of the mall’s 62 booths.

Authorities seized about 250,000 fake products, including over 72,000 items carrying Louis Vuitton’s trademarks, with an estimated market value running into tens of millions of dollars.

Court filings showed Louis Vuitton sent more than 30 notices and 20 cease-and-desist letters to Westgate, but the management allegedly failed to act. The brand argued the mall placed rental income and customer traffic above curbing illegal sales.

Westgate had previously faced legal action and was placed under a permanent injunction for allowing fake Ray-Ban glasses to be sold on its premises.

While Louis Vuitton may not recover the full $584m award, legal experts say the ruling poses a significant financial burden for the mall’s owners and sends a strong warning to landlords who turn a blind eye to counterfeit trade.
